Differences Between Courts and Restorative Justice
 
DIFFERENCES BETWEEN THE CURRENT CRIMINAL JUSTICE SYSTEM AND THE RESTORATIVE JUSTICE SYSTEM


Retributive Justice is the traditional justice system that is currently being used throughout the United States. The Restorative Justice System is increasingly being used in many states both independently, and in combination with the retributive system.

Victims are peripheral to the process
Victims are central in the process
Focus on punishing or treating the offender
Focus on repairing the harm between an offender and victim, and between an offender and the community
Community is represented by the state
Community members or organizations take an active role
Process is characterized by an adversarial relationship between the participators
Process is characterized by dialogue and negotiation between the parties
